What Is a DOT-Mandated SAP Evaluation?

Under U.S. Department of Transportation regulations, any employee in a safety-sensitive position who violates drug or alcohol testing rules — including a positive test, refusal to test, or adulterated specimen — is immediately removed from that role and cannot return until they complete the full SAP process.

This is not optional. 49 CFR Part 40 requires the employer to provide the employee with a list of qualified SAPs. The employee must complete the evaluation before any return-to-duty testing can occur. No SAP evaluation = no return to work.

As a DOT-qualified SAP, we conduct the mandated face-to-face evaluation, recommend education or treatment, verify compliance, and authorize the return-to-duty process — all in full accordance with federal regulations.

The SAP Process, Step by Step

Federal regulations define each step. Here is exactly what happens when you work with us:

1

Initial Evaluation

Face-to-face (or telehealth) clinical interview. We assess the nature and severity of the drug/alcohol violation and the employee's history.

2

Treatment/Education Recommendation

We prescribe the appropriate level of education or treatment. The employee must comply with these recommendations in full.

3

Compliance Verification

We verify the employee has completed the recommended program before any return-to-duty steps begin.

4

Follow-Up Evaluation

We conduct a second evaluation to confirm the employee is ready to return, then authorize return-to-duty testing.

5

Follow-Up Testing Plan

We prescribe a minimum follow-up testing schedule (at least 6 tests in 12 months per DOT rules) and provide written documentation.

Who Needs a SAP Evaluation?

Any employee in a DOT safety-sensitive position who has violated federal drug and alcohol testing regulations, including:

Positive drug or alcohol test result
Refusal to submit to a required test
Observed behavior indicating substance use on duty
Use of prohibited substances while on duty
